Neil Drover T/A The Agency Terms of Business

Because of the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (“the regulations”) which came into force on 6th April 2004, we are required to present you (the hirer”) with our general terms of business and to seek certain information from you to establish your identity.

We, Neil Drover - The Agency, trade as an Employment Business in compliance with the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (As detailed in Statutory Instrument 2003 No.3319) which are referred to as The Regulations.

Neil Drover is a party to each contract and accepts responsibility for its obligations under the terms of each individual agreement. Each individual booking between us will be identified and confirmed in writing. No charge other than the contracted fee is made.

We undertake to establish the identity & suitability of any artiste(s) supplied and to make them aware that they must adhere to all Health & Safety Regulations and Legal Requirements pertaining to each performance/venue. We also confirm that we will have the authority to act on behalf of the artiste(s) and to seek work on their behalf.

If after having arranged any artiste(s)for you, we are made aware that any such Artiste(s) is unsuitable for the engagement in question, we are obliged to bring this to your attention and possibly to terminate the engagement. In that circumstance we will endeavor to replace the artiste or to reach an agreement with all the parties concerned.

The artiste is employed under a Contract for Services. The artiste is not entitled to any holidays, or holiday pay since the artiste(s) will be either self employed or an incorporated body.

We are obliged to make reasonable enquiries with you as to Health & Safety risks or other legal requirements applying to you/the venue before supplying any artiste(s) to you. Equally we will advise you of any special requirements of any artiste(s) we supply and if applicable of any risks involved in the presentation of the artiste’s act /performance.

Neil Drover we will keep all contracts, confirmations and letters for one year after the completion of the relevant engagement.

We will document the involvement of any other Employment Agency or Employment Business in our contracts/confirmations issued.

All artiste(s) is/are advised to carry Public Liability Insurance and where applicable, to have their equipment PAT certified.

All cheques in settlement should be made payable to Neil Drover-The Agency. For BACS purposes our Bank Sort Code is 83 2128, Account No. 00142765. Our Payment terms will be stated on our confirmation letter. Our invoices will clearly state the account to which payment should be made.

No servant or agent of this agency has the power to vary these terms and conditions.

Any contract negotiated through this agency shall be subject to these terms of business unless otherwise agreed in writing between all concerned parties. In particular, any conflicting terms of business shall have no effect. All contracts to which these conditions apply shall be construed in accordance with English Law.

If any part of this agreement should be held invalid, it shall be to the extent that it be severed, and the remaining provisions shall continue to have full force and effect.

This document covers all artistes supplied by Neil Drover and are terms of Business that will apply to our trading together.
